1.3 Afterwards, GOLOCAL will contact the user via email to confirm the booking of services and provide a link for payment through the means available. To confirm booking by payment, the User must follow the instructions in the email.
1.4 A Contract to participate in a selected tour only becomes effective after the partial payment of the booking in currency.
2. ABOUT WHO CAN REGISTER AND BUY IN THE WEBSITE
2.1 The GOLOCAL services are available for purchase only by those who are legally entitled to contract and use those services. Legal entitlement is defined in articles 3º and 4º of the Brazilian Civil Code (Law nº 10,406/02). Specific individuals might be temporarily or definitively prevented from buying from GOLOCAL due to previous improper behavior.
2.2 The same person cannot register on the GOLOCAL website with more than one CPF number. If GOLOCAL detects duplicate numbers, it can disable all entries.
2.3 Legal entities can register by means of their legal representative.
3.1 For each product on its Website, GOLOCAL shows a descriptive page with information regarding its characteristics, composition, possible risks to health and safety, place of departure, conditions of booking, payment and total price.
3.3 As a general rule, GOLOCAL will not accept changes of purchase (payment methods, quantities, location, date, etc.) after the completion of this process, since the purchase is performed by means of third party companies responsible for managing payments.
3.4 GOLOCAL may not intervene in the relationship between the User and the companies responsible for managing payments, since these companies run their operations regardless of GOLOCAL.
3.5 GOLOCAL cannot guarantee in any way that the services provided by the companies responsible for managing payments will work free of errors, interruptions, malfunctions, delays or other imperfections.
3.6 GOLOCAL is not responsible for unavailability or malfunction of the services provided by the companies responsible for managing payments.
4. PRIVACY OF INFORMATION
4.1 GOLOCAL will take all the possible measures to keep confidentiality and the security of data, however, we will not answer for damage that can be derived from the breaking of these measures by a third party using public nets or the Internet to subvert security systems and have access to the Users´ information.
5. OBLIGATIONS OF THE USERS
5.1 The buying User, after confirming the purchase, is committed to its full payment. The purchase is irrevocable, in the terms of articles 427 and 429 of the Civil Code, excepted in special circumstances.
5.2 When purchasing through the website, the User declares to be aware of the conditions of receipt and/or use of the product and/or service published on the site.
5.3 GOLOCAL is not responsible for the tax obligations of the Users or of the Services Providers. As by current legal rules, the consumer must demand an invoice directly from the Services Providers.
6. WITHDRAWALS, TRANSFERS AND CANCELLATIONS
6.1 The User will have 7 (seven) calendar days after the purchase to request cancellation with full refund of the amount paid. After this period, cancellation requests may imply that the values paid are converted into credits toward new purchases in the GOLOCAL website.
6.1.1 The deadline for use of any credits is 6 (six) months from their granting and they can be fully or partially used within this period of time.
6.2 After the legal period for repentance, provided for in clause 6.1 above, the refund in case of cancellation is as follows:
- Up to 31 days before the beginning of the trip: 90% refund
- Between 30 and 21 days before the beginning of the trip: 80% refund
- Between 21 and 14 days before the beginning of the trip: 70% of the amount paid, according to the expenses actually incurred by the local services provider as a result of the withdrawal.
- Less than 14 days of travel: no refunds and 100% of the amount paid will reimburse the local services provider for their expenses and/or sales that were not performed due to the User´s reservation.
6.3 In all cases, the User will be responsible for any fines applied by the service provider, in addition to the above.
6.4 The User who does not appear in the tour location indicated at time of departure, abandon or withdraw from the contract after the beginning or during the tour, or who unilaterally modifies the conditions contracted, will assume all the resulting expenses, GOLOCAL and Service Provider being free of reimbursement or compensation for unused or replaced services.
6.5 When the execution of the services purchased depend on a minimum number of participants and this number is not reached, GOLOCAL reserves the right to cancel the purchased tour and/or accommodation by notifying the User ahead at least of 72 hours. In case of cancellation of the tour by the Service Provider, the User can choose another tour in the same date or the same tour on another date. In this case, the User can also choose to be fully refunded by GOLOCAL within 15 calendar days.
6.6 If technical-operational reasons, force majeure or unforeseeable circumstances, prevent the fulfillment of all or part of the services contracted, GOLOCAL and its local partners could promote the necessary changes, and are not obliged to refund the amounts paid.
7.1 GOLOCAL may warn, suspend or terminate, temporarily or permanently at any time, an User account and initiate appropriate legal actions if:
b) the User breaches their duties as a User;
c) the User practice fraud or illegal acts;
d) the User’s identity cannot be verified, or any information provided by them is incorrect; or
e) If GOLOCAL understands that some User’s attitude has caused damage to third parties or to GOLOCAL itself, or has the potential to do so. In the case of disqualification of User registration, all purchases will be automatically cancelled. GOLOCAL reserves the right at any time, and at its sole discretion, to request the User’s personal documentation to clarify any type of apparent irregularity, as well as to update the registration of its customers.
8. USE POLICY AND RESPONSIBILITY
8.2 GOLOCAL is not the owner of the products and/or services available in the website, it doesn’t keep possession of them and does not provide tours directly to Users. Furthermore, GOLOCAL does not intervene in the delivery and/or use of the products and/or services purchased through the site. GOLOCAL is solely a mediator of the products/services available for purchase on its website.
8.3 GOLOCAL recommends that all activities are carried out with caution and good judgment. The User must weigh the risks of the activities involved, there being no interference of GOLOCAL on decisions taken by its Users.
8.4 In view of the impossibility of integral and uninterrupted functioning of any telecommunication or computer system during 365 days for year, 24 hours a day, GOLOCAL does not guarantee the provision of its services uninterruptedly and/or exempt of errors.
9. SCOPE OF SERVICES
9.1 GOLOCAL acts as an intermediary between, for example, tourist agencies, hotels and tour operators, all referred as Service Providers, not assuming, therefore, any liability for damage caused to Users or third parties in cases of accidents which have occurred during tours purchased in the website.
9.3 The advertisements and brochures containing the complete tour prices or rates comply with the legal norms of advertising, having their validity restricted to the periods mentioned on them. However, they may suffer changes or variations by economic reasons or by determination of authorities. During high season, long holidays, events, celebrations and commemorations, tours and accommodations may suffer price increase, due to increased demand of tourists. Changes in arrival or departure times and hotel relocation can also occur, in addition to possible changes in local programs, with no effect on the quality of services.
9.5 GOLOCAL is not liable for any damage, injury or loss caused to the User by faults in the system, on the server or on the internet cause by third parties. GOLOCAL will not be responsible for any virus that can attack the user equipment due to access, use or browsing the Internet or as a result of the transfer of data, files, images, text, videos or audios. Users cannot assign to GOLOCAL any liability or require payment for lost profits because of technical difficulties or failures in the systems or the internet. Eventually, the system may be unavailable for technical reasons or failures of the internet or any other fortuitous event or force majeure out of the control of GOLOCAL.
